1. Scope

These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) apply to all orders placed and contracts concluded (hereinafter referred to as “orders”) via the online shop of Monbôsapin (hereinafter referred to as “monbosapin.ch”).

Monbosapin.ch reserves the right to amend these GTC at any time. The version of the GTC valid at the time of the order shall apply. It cannot be unilaterally modified for the order in question.

2. Offer

The offer is aimed at natural and legal persons domiciled or headquartered in Switzerland. Products are only delivered to addresses located in Switzerland.

The offer is valid as long as it appears in the online shop and while stocks last. Price and assortment changes are possible at any time. The images presented in advertising, the online shop, etc., as well as all information regarding the products, serve for illustration purposes only and are not binding.

3. Prices

Prices are quoted in Swiss francs (CHF).

The price indicated in the online shop at the time of the order is binding.

Additional payable services such as delivery are shown separately in the shopping cart and on the invoice.

4. Order

The display of products in the online shop is not legally binding. It is an online catalog provided for informational purposes, intended to invite customers to order the product in this way. Monbosapin.ch reserves the right to limit delivery quantities for certain products and to decline delivery.

An order in this context is considered a request to conclude a contract with Monbosapin.ch.

After the order has been submitted, the customer automatically receives an acknowledgment of receipt confirming that the order has been received by Monbosapin.ch. Once the order has been processed, the customer can no longer amend or cancel it.

Monbosapin.ch may, without justification, refuse all or part of an order. In such cases, the customer will be informed and any payments already made will be refunded.

5. Conclusion of the Contract

The contract is concluded after the order has been processed.

6. Delivery

Delivery area

The customer’s delivery address must be in Switzerland, and deliveries are carried out by Swiss Post.

No deliveries are made on Sundays or on official national or cantonal public holidays.

If the customer is not present at the time of delivery and has not provided specific delivery instructions, the goods will be placed at the entrance of the house or apartment, at reception, or at the entrance of the company. The tree may also be handed over to a neighbor in the same building if the customer has entered the neighbor’s address and phone number in the “Optional Information” section of their account before placing the order. If the customer’s mailbox belongs to a mailbox system, the delivery agent will place a collection note in the box. The customer must then collect the delivery from the relevant post office.

Delivery charges are communicated in the online shop and shown separately in the shopping cart and on the invoice.

7. Warranty

We are convinced of the quality of our product. The warranty is 2 years, valid from the date of purchase. Please keep your proof of purchase.

There is no general right of return for products that are free from defects and correctly delivered.

In the event of a defect, Monbosapin.ch will inspect the disputed product and decide whether the defect falls within the scope of the warranty. If confirmed, Monbosapin.ch may, at its sole discretion, repair the defective product or replace it with an identical or similar product. If the defect is covered by the warranty, Monbosapin.ch will cover the costs of repairs, replacement parts, and return shipping.

Exceptions

The warranty does not cover products that have been improperly stored, assembled, or installed, used inappropriately, subjected to excessive stress, misused, altered, or cleaned with unsuitable methods or products. Normal wear and tear, cuts, scratches, and damage due to impacts or accidents are also excluded. Unless otherwise stated, no warranty is granted for products stored or used outdoors or in damp environments, or used in contexts other than private, domestic use. Warranties do not cover indirect or accidental damage. Warranty rights are limited to the original purchaser and are non-transferable.

8. Complaints

If products are delivered with visible damage to the packaging or contents, the customer must immediately inform the delivery agent and refuse acceptance, without prejudice to their warranty rights. The customer must obtain a damage confirmation notice from the delivery agent. All transport-related damages must also be reported immediately to Monbosapin.ch.

Furthermore, it is the customer’s responsibility to inspect the ordered products immediately upon receipt.

9. Payment Options

Payments must be made in Swiss francs (CHF).

Electronic payment methods:

The accepted methods of payment are credit cards. For credit or debit card payments, the charge is made after the order has been processed.

10. Applicable Law and Jurisdiction

Swiss substantive law applies to the legal relationship between Monbosapin.ch and the customer, excluding the provisions on conflicts of law and the Vienna Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction for natural persons is Lausanne. The exclusive place of jurisdiction for legal entities is Lausanne.
